Telecoms Package

This directive shall apply to all internet service providers operating within the territory of Denmark, and shall regulate the provision of internet services to ensure a free and open internet. Internet service providers shall not engage in discriminatory practices, including throttling or blocking of online content. The Danish Business Authority shall be responsible for enforcing the provisions of this directive. Internet service providers shall comply with the requirements of this directive within six months of its entry into force.

Internet service providers shall be transparent about their network management practices, including any traffic management measures they employ. They shall provide users with clear and concise information about their internet services, including any limitations or restrictions on access to online content. This information shall be made available to users in a readily accessible format, and shall be updated regularly to reflect any changes to the internet service provider's network management practices. The Danish Business Authority may require internet service providers to provide additional information.

Internet service providers shall not engage in discriminatory practices, including throttling or blocking of online content, except where necessary to prevent network congestion or to comply with a court order. In such cases, the internet service provider shall provide users with clear and concise information about the reasons for the discriminatory practice, and shall ensure that the practice is proportionate to the circumstances. The Danish Business Authority shall have the power to investigate complaints about discriminatory practices and to impose penalties on internet service providers that fail to comply with this article.

The Danish Business Authority shall be responsible for enforcing the provisions of this directive, and shall have the power to impose penalties on internet service providers that fail to comply. The Authority shall also have the power to require internet service providers to provide information about their network management practices, and to conduct investigations into complaints about discriminatory practices. Internet service providers that fail to comply with this directive may be subject to fines or other penalties, as determined by the Authority.

This directive shall enter into force six months after its adoption, and shall apply to all internet service providers operating within the territory of Denmark. Internet service providers shall comply with the requirements of this directive within six months of its entry into force, and shall provide users with clear and concise information about their internet services. The Danish Business Authority shall review the effectiveness of this directive within two years of its entry into force, and shall make recommendations for any necessary amendments. The directive may be amended or repealed by the Danish Parliament.
