accession of Portugal to the European Economic Community

The accession of Portugal to the European Economic Community is hereby ratified, subject to the terms and conditions set forth in the Treaty of Accession. The Government of Portugal shall take all necessary measures to ensure the implementation of the Treaty and the fulfillment of its obligations under the Treaty. The Treaty shall enter into force on the date specified therein, and its provisions shall have the force of law in Portugal. The accession shall be deposited with the Secretary-General of the Council of the European Communities.

The laws, regulations, and administrative provisions in force in Portugal shall be adapted to comply with the provisions of the Treaty of Accession and the acts of the institutions of the European Economic Community. The adaptation of laws and regulations shall be carried out by the competent authorities in Portugal, in accordance with the procedures laid down in the Treaty. The adapted laws and regulations shall enter into force on the date specified in the Treaty, and shall have the same legal effect as the laws and regulations in force in the other Member States. The adapted laws and regulations shall be published in the Official Journal of Portugal.

The Government of Portugal shall designate the authorities responsible for the implementation of the Treaty of Accession and the acts of the institutions of the European Economic Community. These authorities shall have the power to take all necessary measures to ensure the fulfillment of the obligations arising from the Treaty and the acts of the institutions. The authorities shall also have the power to cooperate with the institutions of the European Economic Community and to provide them with all necessary information. The designation of the authorities shall be notified to the Commission of the European Communities.

The accession of Portugal to the European Economic Community shall not affect the rights and obligations of individuals and legal persons arising from the laws and regulations in force in Portugal prior to the accession. The rights and obligations acquired prior to the accession shall be maintained and respected, subject to the provisions of the Treaty of Accession and the acts of the institutions of the European Economic Community. The maintenance of these rights and obligations shall be ensured by the competent authorities in Portugal, in accordance with the procedures laid down in the Treaty.

The Treaty of Accession and the acts of the institutions of the European Economic Community shall have primacy over the laws and regulations in force in Portugal, in case of conflict or inconsistency. The competent authorities in Portugal shall ensure that the provisions of the Treaty and the acts of the institutions are applied and enforced in a uniform and consistent manner throughout the country. The authorities shall also ensure that the provisions of the Treaty and the acts of the institutions are respected and applied by all public and private entities in Portugal. The provisions of the Treaty and the acts of the institutions shall be interpreted and applied in accordance with the principles and rules of the European Economic Community.
