European Union–Turkey border

This law regulates the employment of foreign nationals at the European Union–Turkey border. Employers must obtain a work permit for each foreign employee, which shall be issued by the relevant Turkish authorities. The work permit shall be granted for a specific period and may be renewed upon application. The employer shall be responsible for ensuring the foreign employee's compliance with Turkish laws and regulations.

Foreign nationals employed at the European Union–Turkey border shall be entitled to the same rights and benefits as Turkish citizens, including but not limited to, minimum wage, working hours, and occupational health and safety. Employers shall ensure that foreign employees are aware of their rights and obligations under Turkish law. The employer shall also provide foreign employees with a written employment contract in a language they understand. The contract shall include the terms and conditions of employment, including salary, working hours, and job description.

Employers at the European Union–Turkey border shall be required to pay foreign employees the same salary and benefits as Turkish employees performing the same job. The salary and benefits shall be paid in accordance with Turkish law and collective agreements, if applicable. The employer shall also provide foreign employees with equal opportunities for training and career development. The employer shall keep records of foreign employees' salaries and benefits for a period of five years.

The employment of foreign nationals at the European Union–Turkey border shall be subject to inspection by the relevant Turkish authorities. Employers shall be required to provide inspectors with access to their premises and records, including employment contracts, salary records, and work permits. The inspectors shall have the power to impose fines and penalties on employers who violate Turkish laws and regulations. The employer shall be given the opportunity to rectify any violations before a fine or penalty is imposed.

In the event of a dispute between an employer and a foreign employee at the European Union–Turkey border, the parties shall attempt to resolve the dispute through mediation. If mediation is unsuccessful, the dispute shall be referred to the relevant Turkish court. The court shall apply Turkish law and take into account the principles of international labour law. The court's decision shall be final and binding on both parties.
