Netherlands–Turkey relations

The Netherlands and Turkey shall cooperate in the protection of intellectual property rights, including patents, trademarks, and copyrights, in accordance with international agreements and national laws. This cooperation shall include the exchange of information and best practices, as well as mutual assistance in the enforcement of intellectual property rights. The parties shall also establish a joint committee to oversee the implementation of this cooperation. The committee shall meet annually to review progress and discuss areas for improvement.

The parties agree to recognize and respect the intellectual property rights of each other's nationals, including natural and legal persons, in accordance with the provisions of this agreement and international law. This recognition and respect shall extend to all fields of intellectual property, including literary and artistic works, inventions, and trademarks. The parties shall also ensure that their national laws and regulations are consistent with this agreement. The parties shall notify each other of any changes to their national laws and regulations.

The parties shall provide adequate and effective protection against the unauthorized use of intellectual property, including counterfeiting and piracy. This protection shall include measures to prevent the importation, exportation, and transit of goods that infringe intellectual property rights. The parties shall also provide for the seizure and destruction of such goods, as well as the imposition of penalties on persons involved in these activities. The parties shall cooperate in the enforcement of these measures.

The parties agree to establish a system for the resolution of disputes related to intellectual property rights, including mediation, arbitration, and judicial proceedings. This system shall be fair, transparent, and efficient, and shall provide for the prompt resolution of disputes. The parties shall also ensure that their national laws and regulations provide for the effective enforcement of intellectual property rights. The parties shall notify each other of any changes to their dispute resolution procedures.

The parties shall review and revise this agreement as necessary to ensure that it remains effective in promoting the protection of intellectual property rights. This review shall take into account developments in international law and national laws and regulations, as well as the experience gained in the implementation of this agreement. The parties shall also consider the need for further cooperation and coordination in the field of intellectual property. The parties shall meet annually to review the implementation of this agreement.
