Turkish Penal Code

The Turkish Penal Code shall apply to all individuals who commit crimes within the territory of Turkey, as well as to Turkish citizens who commit crimes abroad. The code shall also apply to foreign nationals who commit crimes against Turkey or its citizens. The code's provisions shall be interpreted in accordance with the principles of the Turkish Constitution and international law. The code's purpose is to protect public order, individual rights, and freedoms.

Any person who engages in fraud or deceit to obtain a benefit or advantage for themselves or another person shall be sentenced to imprisonment for a term of not less than one year. If the fraud or deceit causes significant financial loss or damage to another person, the sentence shall be increased by one-half. The court may also impose an additional sentence of imprisonment for a term of not less than six months if the fraud or deceit is committed in a manner that causes harm to the public interest.

Any person who resists or obstructs a public official in the performance of their duties shall be sentenced to imprisonment for a term of not less than six months. If the resistance or obstruction is committed using violence or threats, the sentence shall be increased by one-third. The court may also impose an additional sentence of imprisonment for a term of not less than three months if the resistance or obstruction causes harm to the public official or their property.

Any person who intentionally kills another person shall be sentenced to imprisonment for a term of not less than twenty-four years. If the killing is committed with intent to cause fear or terror, the sentence shall be increased by one-third. The court may also impose an additional sentence of imprisonment for a term of not less than five years if the killing is committed in a manner that causes excessive suffering. The sentence shall be determined based on the severity of the crime and the culpability of the offender.

A person who is convicted of a crime shall be liable to pay compensation to the victim or their heirs for any material or moral damages caused by the crime. The court shall determine the amount of compensation based on the severity of the crime and the extent of the damages. The compensation shall be paid in addition to any other sentence imposed by the court. The victim or their heirs may also bring a civil action against the offender to claim compensation.
