Algeria–China relations

The Government of Algeria and the Government of China shall cooperate in the protection of intellectual property rights, including patents, trademarks, and copyrights. This cooperation shall be carried out in accordance with the laws and regulations of each country and international agreements to which both countries are parties. The two governments shall exchange information and best practices in the field of intellectual property protection. The cooperation shall also extend to the prevention of intellectual property infringement.

The parties agree to provide national treatment to each other's nationals with regard to the protection of intellectual property rights. This means that each country shall accord to the nationals of the other country treatment no less favorable than that it accords to its own nationals with regard to the protection of intellectual property rights. The parties shall also ensure that their laws and regulations are consistent with international agreements on intellectual property protection.

The parties shall cooperate in the enforcement of intellectual property rights, including through the exchange of information and coordination of efforts to prevent and suppress intellectual property infringement. This cooperation shall include the sharing of best practices and expertise in the investigation and prosecution of intellectual property crimes. The parties shall also provide mutual assistance in the enforcement of intellectual property rights, including the seizure and confiscation of infringing goods.

The parties agree to establish a mechanism for the resolution of disputes related to intellectual property rights. This mechanism shall provide for the prompt and effective resolution of disputes through mediation, arbitration, or other alternative dispute resolution procedures. The parties shall also ensure that their laws and regulations provide for the effective enforcement of intellectual property rights, including the provision of adequate remedies for infringement.

The parties shall review and update their laws and regulations on intellectual property protection to ensure that they are consistent with international agreements and best practices. The parties shall also provide training and capacity-building programs for their officials and stakeholders on intellectual property protection and enforcement. The parties shall cooperate in the development of intellectual property policies and strategies that promote innovation and economic growth.
